A’ARU Collective’s Terms & Conditions



1. Scope of application


These Terms and Conditions apply to the use of A’ARU Collective’s website and all bookings of hotels and services via the integrated reservation system.


2. General use of A’ARU Collective’s website


On the A’ARU Collective’s website you can search for the availability and rates of hotels and rooms of your choice at dates defined by you for a specific number of travellers. A’ARU Collective reserves the right to discontinue its website at any time.


3. Hotel content and categories


All information about a hotel and the descriptions of a hotel are based on the hotel's own assessment. All content about a hotel that is displayed on the A’ARU Collective’s website is approved by the respective hotel.


4. Prices and taxes


All prices displayed on A’ARU Collective’s website are current and shown in the name   of   the   individual   hotel   and   are   valid   for   all   bookings   made   via   the reservation system on A’ARU Collective’s website. We reserve the right to amend advertised prices at any time. We also reserve the right to correct errors in both advertised and confirmed prices.


For United Kingdom, prices displayed on the A’ARU Collective’s website always include service charges and applicable taxes. For other countries regulations and rules regarding taxes differ.


Please   note,   that   a   visitor's   tax   might   apply   in   certain   locations.   In   some countries, a local tax/city tax and/or a service charge is levied on the travel price or room rate. The amount of this tax changes all the time and can’t generally be estimated but requires specific information like the exact period of stay, number of people staying etc. to be calculated. Thus any information regarding such taxes is always noncommittal, as long as you do not enter specific travel dates.


5. Conditions Of Suppliers


Many of the services which make up your holiday are provided by independent suppliers. Those suppliers provide these services in accordance with their own terms and conditions which will form part of your contract with us. Some of these terms and conditions may limit or exclude the supplier’s liability to you, usually in accordance with applicable International Conventions. Copies of the relevant parts of these terms and conditions are available on request from us or the supplier concerned.


6. Accuracy


We endeavour to ensure that all the information and prices both on our website and  in   any   advertising   material   that   we   publish   are   accurate,   however, occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances. You must check the current price and all other details relating to the travel arrangements that you wish to book before you make your booking. Whilst every effort is made to ensure the accuracy of such   information   and   prices   at   the   time   of   printing,   regrettably   errors   do occasionally occur. You must therefore ensure you check all details of your chosen arrangements (including the price) at the time of booking. Obvious errors and mistakes (including misprints) are not binding.


7. Registration


You   can   register   on   A’ARU   Collective’s   website.   If   you   voluntarily   provide personal data as part of such registration, it will be used to prefill the personal details form upon making a booking, and/or be used to provide you with more refined topics in our communications, should you have opted in to any of our newsletters. You can cancel your registration with A’ARU Collective at any time.


8. Accommodation contract and payment


If you make a booking through A’ARU Collective Limited’s reservation system the accommodation contract comes into effect between you and the hotel of your choice or with a third party provider.


If an online accommodation booking is made, A’ARU Collective will email out a booking confirmation that also doubles as the hotel voucher that must be presented to the Hotel upon arrival.


Terms  and  conditions  are  provided  at  the  time  of  booking  with  each  rate stipulating if payment is made in advance or paid locally. Any claims and obligations out of the accommodation contract only exist between you and the hotel chosen by you. A’ARU Collective’s does not enter into the contract with you about the accommodation. Rates available and any booking made via the A’ARU Collective’s   reservation   system   can’t   be   combined   with   other   offers   or promotions.


Bookings   take   place   according   to   the   best   and   currently   lowest   A’ARU Collective’s day price in each case. This price is submitted either directly by the hotel for the arrival date chosen or through a third party provider, and is shown in the name of the hotel.


9.   Making   a   booking


If you want to make a booking after your availability search, you will have to fill in personal details about you and your credit card details. If you are logged in to your   account   the   personal   details   will   be   pre-filled.   By   clicking   the   button “Confirm Booking” you make a binding offer to book the selected room. Prior to making the booking, i.e. prior to clicking the button, you can identify any errors in the data you have provided directly on the website.


Every booking offer you make will be forwarded to the corresponding hotel and any messages from the hotel to you, particularly the confirmation of your booking will be forwarded to you via A’ARU Collective as carrier of the message. A’ARU Collective shall have a relationship with you and the hotel only as an independent third party and shall not be a partner, trustee, representative or sub-contractor either for you or the hotel. As soon as you receive the booking confirmation via the A’ARU Collective’s reservation system, you have entered into a contract and the booking is binding. You will receive a customer booking reference number together with the confirmation of your booking. The use of the A’ARU Collective’s reservation system is free of charge for you. Bookings are not transferable to any other person and can not be transferred or exchanged for cash or credit.


10. Cancellations


You do not have a statutory right of withdrawal from a booking. However, a hotel or third party may voluntarily offer a right to cancel or change a booking for selected offers in the A’ARU Collective’s reservation system. Any such right will be displayed in the order form before you make your order. Where a hotel or third party voluntarily grants such right to cancel or to change a booking in the A’ARU Collective’s reservation system, any such changes and cancellations have to be carried out via A’ARU Collective’s online system or via A’ARU Collective’s reservation number to be fully effective. In case of a change or cancellation carried out directly at the hotel, A’ARU Collective cannot provide any information concerning possible discrepancies concerning the date of the cancellation or the fact of cancellation as such.


11. Events Beyond Our Control


Except where otherwise expressly stated in these Terms and Conditions we (or the Supplier/Principal, where we are acting as an agent) will not be liable or pay you compensation if our contractual obligations to you are affected by Events Beyond Our Control. For the purpose of these Terms and Booking Conditions, Events Beyond Our Control means any event beyond our, the Supplier/Principal or our/their supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken, this can often be known as force majeure or act of God. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination (including but not limited to Covid-19 or future strains of Covid-19 and the ongoing effects of Covid-19), epidemic, pandemic or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including any port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events beyond our or the supplier(s) concerned’s control.


12. Foreign Commonwealth & Development Office Advice


You are responsible for making yourself aware of Foreign, Commonwealth and Development Office (FCDO) advice in regard to the safety of the countries and areas in which you will be travelling and to make your decisions accordingly. Advice from the FCDO to avoid or leave a particular country may constitute Events Beyond Our Control.


13. Insurance


Adequate travel insurance must be purchased to cover your travel plans, taking into account any participation in sports and activities whilst during your trip. It is the traveller's responsibility to purchase the relevant level of travel insurance.


You   must   be   satisfied   that   your   insurance   fully   covers   all   your   personal requirements including pre-existing medical conditions, cancellation charges, medical expenses, any and all excursions and activities you partake in and repatriation in the event of accident or illness.


If you choose to travel without adequate insurance cover, neither we nor the Supplier/Principal will not be liable for any losses howsoever arising, in respect of which insurance cover would otherwise have been available.


14. Visa Information


Your specific passport/entry/immigration requirements, for the destination to which you are travelling, are your responsibility and you should confirm these with the relevant Embassies and/or Consulates.


We are unable to accept any responsibility if you cannot travel because you have not complied with any passport/entry/immigration requirements. For all holidays where a passport is required to be sent to an embassy, it should be noted that once your passport has been lodged with the embassies, you will be unable to retrieve it until the visa has been issued. It is therefore important that you do not require your passport during this period. A’ARU Collective will not be liable if any delay occurs within the embassy.


15. Special Requests


Any special requests must be advised to us at the time of booking e.g. diet, room location, a particular facility at a hotel etc. Whilst every effort will be made by us (or the Supplier/Principal, where we are acting as an agent) to try and arrange your reasonable special requests, we cannot guarantee that they will be fulfilled. The fact that a special request has been noted on your confirmation invoice or any other documentation or that it has been passed on to the supplier is not confirmation that the request will be met. Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed by us. We do not accept bookings that are conditional upon any special request being met. Unless otherwise stated, accommodation bookings do not include transfers from airports/hotels/ports/stations and vice versa
